1. Background
1.1. The guidelines below provide a list of Common Breaches and Outcomes for the Student Rights & Responsibilities Policy.
1.2. A Common Breach is a breach that is more frequently the subject of a Complaint under the Policy. The list of Common Breaches is not exhaustive and, subject to the Policy, a Complaint may be pursued for a breach other than a Common Breach.
1.3. A Common Outcome is an outcome that is typically assessed. However, a variety of factors are considered when assessing the appropriate outcome including the need to:
1.3.1. mitigate risk and attend to the needs and security of the University community
1.3.2. ensure outcomes are proportional to the breaches committed
1.3.3. ensure that to the extent an outcome would impact a student’s academic success, the impact is reasonable under the circumstances
1.3.4. ensure outcomes consider the mental health and wellbeing of all parties
1.3.5. respond to impact(s) experienced by an individual or community
1.3.6. encourage student learning and development
1.4. An outcome, other than a Common Outcome may be assessed, where permitted by the Policy with the approval of the President.
1.5. Outcomes are normally progressive, and a subsequent breach will normally result in more severe outcomes, regardless of whether the subsequent breach is related or similar to a prior breach.
2. Common Breaches
2.1. Failure to Uphold Responsibilities with Regard to Diversity – Students have a responsibility to help create and uphold an environment that respects the diversity and differences of members of our campus, and allows all members to be treated with dignity, worth and respect. An example of this type of responsibility is the requirement to abide by the University’s commitment to the Ontario Human Rights Code and the Human Rights at the University of Guelph Policy including but not limited to refraining from engaging in activities that express intolerance on grounds prohibited by the Human Rights at the University of Guelph Policy.
2.2. Failure to Uphold Laws or Policies – Students have a responsibility to abide by all Federal, Provincial and Municipal laws and University policies.
2.2.1. Information Technology (IT) - to use computer login codes or passwords and University IT resources (e.g., computing account or workstation) in accordance with the University’s Acceptable Use Policy. (Previously Section 9d)
2.2.2. Failure to Fulfill or Abide by Outcomes & Measures – failure to fulfill or abide by outcomes or measures, including interim measures, imposed pursuant to this policy or any other non-academic University policy.
A charge of Failure to Fulfill or Abide by Outcomes & Measures will normally be subject to an Adjudicated Resolution before the University Hearing Board.
2.3. Substance Use – Students have a responsibility to abide by all Federal, Provincial, Municipal laws and University policies with respect to possession and/or use of regulated or controlled substances including but not limited to:
2.3.1. Drugs and Drug Paraphernalia – to not possess, use, supply or traffic illegal drugs, drug paraphernalia or controlled substances.
2.3.2. Alcohol - to not possess, purchase, or use liquor while under the age of 19. The sale or provision of alcohol to anyone under the age of 19 is prohibited. Consumption or open possession of liquor is prohibited on campus other than in those areas where it has been specifically permitted.
2.3.3. Cannabis – to not possess, purchase, or consume while under the age of 19. Provision to those under the age of 19 is prohibited. The sale of cannabis is prohibited. The smoking of cannabis on campus is prohibited under the University’s Tobacco and Smoke-Free policy.
2.3.4. Smoking & Tobacco Use - to abide by the University’s Tobacco and Smoke-Free policy, which includes not smoking tobacco or cannabis or using an electronic cigarette or other similar device while on the University of Guelph Campus.
2.4. Failure to Uphold Responsibilities with Regard to Security – Students have a responsibility to support community members’ access to the tools they need to engage in their learning and development, both in and outside of the classroom, and to generally support the security and integrity of the University environment. An example of this type of responsibility is the requirement to abide by the following:
2.4.1. Access to University Campus & Facilities - to respect posted hours and limits on entry.
2.4.2. Access to Animal Facility Without Authorization - to respect posted hours and limits on entry to campus animal facilities.
2.4.3. Property - to not destroy, tamper with, deface or vandalize, monopolize, unlawfully access, remove, obtain through fraudulent means, or possess property not your own, including but not limited to property of the University and personal property.
2.4.4. Disruption - to not interfere with the normal functioning of the University, nor to intimidate, interfere with, threaten or otherwise obstruct any activity organized by the University, including classes, or to hinder other members of the University community from being able to carry on their legitimate activities, including their ability to speak or associate with others.
2.4.5. Permits and Identification - to not acquire, use, loan or disseminate University or government identification, express plans, building access cards, bus passes, parking permits or other credentials that are stolen, borrowed, cancelled, lost, false, altered or expired. To not loan any of your identification to others nor alter or produce fake identification. (Previously Section 9e)
2.4.6. Cooperation – to abide by the written directions or oral instructions of the Campus Safety Office or any other officer or agent of the University when acting within the scope of their authority.
2.5. Failure to Uphold Responsibilities with Regard to Safety – Students have a responsibility to support an environment that enables all members of the University Community, including students, faculty, staff, visitors and guests, to be safe and free from harm. An example of this type of responsibility is the requirement to abide by the following: (Previously Section 11)
2.5.1. Harassment - to treat all members of the University community with respect and without harassment. Harassment is defined as any attention or conduct (oral, written, virtual, graphic or physical) by an individual or group who knows, or ought reasonably to know, that such attention or conduct is unwelcome/unwanted, offensive or intimidating. Examples include but are not limited to bullying, and hazing. Hazing is further defined in the University’s Anti-Hazing Protocol. (Previously Section 11a)
2.5.2. Health & Safety - to not engage in activities that are likely to endanger the health or safety of yourself or another person, or to assault or threaten to assault another person or to knowingly cause another person to fear bodily harm. (Previously Section 11b)
2.5.3. Firearms and Other Weapons - to not possess or bring onto campus any firearms, weapons, or replicas (examples include but not limited to: BB guns, slingshots, paintball guns, firecrackers, gunpowder or any other forms of unauthorized hazardous materials). Students are not allowed to use any objects to injure, threaten or intimidate a person. (Previously Section 11c)
2.5.4. Fire and Life Safety Equipment - to not tamper or interfere with, discharge or activate any life safety or fire equipment on campus unless for the purposes of responding to an emergency. Life safety equipment includes but is not limited to defibrillators, fire extinguishers, fire alarms and emergency phones. (Previously Section 11d)
2.5.5. Guests - to take reasonable steps to ensure their guests comply with this Policy. Students may be held responsible for any breach of the rules committed by their guests on campus. (Previously Section 11e)
3. Common Outcomes
Outcomes Available Through All Resolution Processes
3.1.1. Apology – A student may voluntarily agree or be requested to make amends to any individuals impacted as a result of their actions. An apology can be written or delivered in another format. The format of the apology should be chosen to limit further harm.
3.1.2. Warning - A warning makes clear that the harm or misbehavior must not be repeated and identifies the consequences of a repeat breach.
3.1.3. Non-academic Probation - A student may be placed on non-academic probation for a period of up to nine (9) semesters or until the completion of their current academic program. A student who has been placed on non-academic probation is expected to exercise significant caution with regard to their conduct and take all reasonable steps, short of undue hardship, to avoid reoffending during the probationary period. In keeping with the principle of progressive discipline, the outcomes for a subsequent breach of the Policy during a probationary period will be more significant than when a student is found responsible for a first breach or otherwise found responsible of subsequent breach.
3.1.4. Restitution - A student may voluntarily agree to or be ordered to pay the cost(s) or any portion of the cost(s), of any damages to University property or personal property destroyed in whole or in part by the student, or to otherwise make financial amends to cover any costs incurred by the University or an other party as a result of the actions of the student.
3.1.5. Fine - A student may voluntarily agree to or be ordered to pay a fine of any amount, up to a maximum amount of $1000 per breach.
3.1.6. Conditional Fine - A student may be assessed a conditional fine of any amount, up to a maximum amount of $1000 per breach. A conditional fine is to be paid only in the event that the student is found responsible for a subsequent breach during a designated time period not to exceed three (3) years. Where no time period is designated, the time period shall be deemed to be one (1) year or until the successful completion of the student’s current academic program, whichever comes first.
3.1.7. Educational Outcome - A student may voluntarily agree to or be ordered to engage in a community or educational outcome. The program may include but is not limited to a personal or guided reflection, a review of one of the University policies with the appropriate office and/or participation in an educational program.
3.1.8. Behavioural Agreement- A student may agree or propose, as part of a Resolution Process, to a set of behavioural expectations, terms, and/or conditions for any period through to the completion of their current academic program. A Behavioural Agreement may not include any expectations, terms, and/or conditions that have a substantially similar effect to one of the other Common Outcomes provided in this section. A breach of a Behavioural Agreement constitutes a breach of the Policy and may result in more serious outcome.
3.1.9. Forbid Entry to Certain Premises - A student may voluntarily agree to not enter or be forbidden from entry to any building or buildings, or areas of the University’s premises, for a period of time deemed appropriate. Students who have been forbidden entry to certain premises may be the subject of a Trespass Order issued by the Campus Safety Office.
3.1.10. Removal of Objects - A student may voluntarily agree to or be ordered to remove objects from the University’s premises or any part thereof, for such period of time as appropriate.
3.1.11. Restrictions on Computing Privileges – A recommendation may be made to the University’s CIO or designate as to appropriate restrictions on a student’s University computing privileges, as well as the period of time such restrictions should be in force.
3.1.12. Restricted Access - A recommendation may be made to the Vice-Provost Student Affairs that a student be restricted from any University-related academic, athletic, social or other activity for a period of time.
3.1.13. Restricted Communication and Contact - A recommendation may be made to the Vice-Provost Student Affairs to prohibit a student from communication and/or contact with any other University student, staff or faculty member. Such a prohibition may be complete or subject to such conditions and limitations as the Vice-Provost Student Affairs imposes.
3.1.14. Voluntary Withdrawal – A student may agree, as part of a Resolution Process, to withdraw from the University for up to three (3) semesters or any part thereof. A student’s agreement to withdraw becomes binding and irrevocable upon the expiration of any right to withdraw from or appeal the outcome of the Resolution Process.
No record of a voluntary withdrawal will appear on the student’s transcript. However, a student who voluntarily withdraws remains subject to University policies with respect to withdrawal, including, but not limited to, with respect to dropping courses and tuition refunds.
Outcomes Available through the Adjudicated Resolution Process
3.1.15. Suspension - A recommendation may be made to the Vice-Provost Student Affairs that a student be suspended for up to six (6) semesters. A suspension shall be recorded permanently on a student’s transcript. A student may make a request to the University Hearing Board to have the record of suspension expunged no sooner than five years after the date of last registration.
A student who is suspended for non-academic misconduct will not receive credit for any courses taken while under suspension. This policy applies to any credit course taken during the suspension period, be it distance, or non-campus, taken in open learning programs at the University of Guelph or at another post-secondary institution. In addition, in the case of graduate students, any research or writing completed during the suspension period may not be submitted in fulfillment of program requirements once the period of suspension has concluded.
Readmission following a suspension for non-academic misconduct will be granted upon request provided that such a request is received by the last day of the semester following the conclusion of the suspension. Requests received after the last day of the semester following the conclusion of the suspension are subject to Senate-approved regulations on readmission.
Readmission may be subject to such reasonable conditions as the adjudicator may impose at the time of their original decision to ensure the successful reintegration of the Student into the University community including, but not limited to, reintegration planning or check-in meetings with the Student Accountability Office. No readmission condition may extend beyond one (1) year from the date of readmission.
Expulsion - The University Hearing Board may recommend to the President that a student be expelled from the University. An expulsion shall be recorded permanently on a student’s transcript.
A student who has been expelled from the University of Guelph is not eligible for readmission to the University for at least five years. A student who wishes to be considered for readmission or to have their record of expulsion expunged must petition the President who will follow the Senate-approved process for considering the petition.
4. Suspension and Expulsion Guidelines and Considerations
4.1. Guidelines for Applying Suspension as an Outcome
A suspension may be warranted where the following circumstances are present, but may be warranted in other circumstances:
- Repeated Misconduct: If a student repeatedly engages in non-academic misconduct after receiving prior warnings or lesser outcomes.
- Serious Misconduct: If the misconduct is serious enough to warrant a temporary removal from the University community. This could include acts of violence, harassment, or other behaviors that significantly disrupt the University environment.
- Risk to Community: If the student’s continued engagement with the University community poses a risk to the safety or well-being of others.
Guidelines for Applying Expulsion as an Outcome
An expulsion may be warranted where the following circumstances are present, but may be warranted in other circumstances:
- Severe Misconduct: If the misconduct is so severe that it warrants permanent removal from the University. This could include serious acts of violence, assault, or other criminal behavior.
- Repeated Serious Misconduct: If a student engages in serious misconduct on multiple occasions, despite previous significant penalties.
- Unwillingness to Meaningfully Improve Conduct: If there is clear evidence that the student is unwilling or unable to follow University standards and expectations.
4.2. In addition to the general considerations provided above, prior to assessing or confirming a suspension or expulsion, individuals involved in the decision-making process should consider the following factors:
4.2.1. The University’s primary purposes are the advancement of learning, the dissemination of knowledge, and the intellectual, social, moral and physical development of its members and the betterment of society. Accordingly, the University should only take action to suspend or expel a student where doing so supports these purposes or is necessary to protect them.
4.2.2. Whether a period of rustication and reflection away from the University is likely to be beneficial to the student and or the University.
5. Common Outcome Guidelines for use in the Adjudicated Resolution Process
The table below presents guidelines for Case Managers and the University Hearing Board to consider when assessing outcomes. The guidelines below are not intended to be prescriptive or to limit the discretion of Case Managers and the University Hearing Board to assess Outcomes in accordance with the Policy.
These guidelines are intended for use with the Adjudicated Resolution Process, nothing in this procedure shall be interpreted to prevent or compel their use to inform other resolution processes under this policy.
In determining whether a breach is minor or major the Case Manager or University Hearing Board should consider:
- The views of all parties
- The degree of the risk incurred by all parties as a result of the breach
- The severity of the harm caused
- The impact of the breach on any victims
- The accused student’s degree of responsibility
- The potential for ongoing risk or harm
In assessing an outcome, the Case Manager or University Hearing Board should consider:
- The nature and gravity of the breach
- The culpability and disciplinary history of the accused student
- Any aggravating or mitigating circumstances
- The proportionality of the outcome to the breach
