Offences that are set fine eligible

Certain charges under the Policy on Non-Academic Misconduct are set fine eligible. This means that if the student admits responsibility for the offence they can pay a set fine (and restitution if applicable) without going to a hearing. The set fine option is only available when it is a student’s first breach and in addition to paying the set fine, the student will be placed on Non-academic Probation for two semesters. The following are breaches that are eligible for Notices of Offence and the section reference under the Policy:

I have been told by Student Judicial Services that my charge is Set Fine Eligible

For offences that occurred outside of residence, Student Judicial Services will normally email you within seven (7) business days of you receiving your Notice of Offence. In that email, Student Judicial Services will let you know if your offence is set fine eligible. If your offence is set fine eligible, you must contact Student Judicial Services at judicial@uoguelph.ca within seven (7) business days to enter a response. If you do not enter a response during this time, “Responsible” will be automatically entered and an invoice for the fine will be sent to you for payment.

Responsible

 

Students admit that they are responsible for the alleged breach of the Policy on Non-Academic Misconduct.

If the offence is set fine eligible (based on the nature of the offence and the fact that it is the students first breach) then entering a plea of responsible means that the student will be invoiced for the amount of the set fine and restitution (if applicable). The student will also automatically be placed on non-academic probation for two semesters. The student will not be required to attend a hearing. Following a plea of responsible, to an offence that is set fine eligible, an invoice will be sent to your University of Guelph email.  Payment can be made online through internet banking or through Student Client Services (3rd floor, University Centre).  No hearing will take place, however, an automatic status of Non-academic Probation (for two semesters) will be assigned.
  

Responsible with Explanation

 

Students admit that they are responsible for the alleged breach of the Policy on Non-Academic Misconduct, but there are extenuating circumstances that they want to bring to the attention of the Judicial Committee. 

By pleading responsible with explanation, a hearing will be set before the Judicial Committee. At the hearing you will have the ability to present an explanation or any extenuating circumstances.  This does not necessarily result in a lesser fine but rather is an opportunity for you to tell your story and present any factors you wish the Committee to consider.  An automatic status of Non-academic probation (for two semesters) will be assigned to students who are found responsible.

Not Responsible

 

Students do not admit responsibility for the alleged breach of the Policy on Non-Academic Misconduct. 

By pleading not responsible, a hearing will be set before the Judicial Committee. If you demonstrate to the Committee that the charge is unwarranted, the charge will be disposed of. Otherwise, the Judicial Committee will decide what the outcomes will be. In addition to other outcomes, an automatic status of Non-academic probation (for two semesters) will be assigned.
Yes, I wish to plead not responsible.
